Upon hearing his interview with late night host, Stephen Colbert was not being televised, the Democratic candidate from Texas gave a brilliant response:

And now they’re trying to control what we watch, what we say, what we read… And this is the most dangerous kind of cancel culture— the kind that comes from the top… Corporate Media Executives are selling out the first amendment to curry favor with corrupt politicians. And a threat to any of our first amendment rights is a threat to all of our first amendment rights.” -Texas State Representative James Talarico (D-Austin)

It’s just due to the “equal time rule”. There’s a federal law that goes back to the introduction of radio in the 20s which states that broadcast stations have to provide equal access to competing political candidates. So if a US broadcaster, like CBS, NBC, FOX, CNN… presents anything that could be interpreted as a message from a political candidate, it it has to give the same amount of time with the same amount of exposure to an opposing candidate. Talk shows used to be able to claim a “news” exemption; but they can’t anymore.

Right— late night / talk shows were exempt until Trump appointed Carr as chair of FCC in 2025 and then last summer I think Carr said he was ‘thinking about’ changing the rule… Even still, the rule change has not been made official. Colbert said the order not to air the interview came from cowering CBS execs. Colbert further objected that he has twice interviewed Talarico’s Dem primary opponenet, Jasmine Crockett. Though neither is a Republican of course.

Yes… But it’s something that’s been a debated, if not abused exception dating back to at least Bill Clinton playing the sax on the Arsenio Hall Show. And Colbert is certainly an endorsement. CBS just didn’t want to have to give equal time to a Republican. And Colbert was still free to spin it however he wanted in order to get the mileage for his rubber stamp…. First Amendment. Just the usual politics.
